Trip of a Lifetime" Sweepstakes Official
Rules
NO PURCHASE NECESSARY. A PURCHASE WILL NOT
IMPROVE YOUR CHANCES OF WINNING.
1)
ELIGIBILITY: Open to legal
U.S. residents residing in the states of
Alabama, Georgia, Florida & Mississippi
who are at least 21 years of age or older
at time of entry. All employees, directors
and officers of Sponsor (as defined below
in Section 8) and the King and Prince Hotel
Beach & Golf Resort, Studio412, their
affiliates, subsidiaries, distributors, retailers,
agents, sales representatives, their advertising
and promotion agencies, and their family
members (that may include, without limitation,
parent, child, sibling and spouse of each
by current or past marriage(s)) and household
members of each are not eligible. Void
outside Alabama, Georgia, Florida, Mississippi
and where prohibited by law. Sweepstakes
starts at 12:00:01 a.m. Eastern time on 4/01/08,
and ends on 7/18/08 at 11:59:59 p.m. Eastern
time ("Promotion Period").
2) HOW TO ENTER: There
are three ways to enter the “Fishing
Trip of a Lifetime” Sweepstakes:
A. Access www.southernlinc.com/fishingtrip during
the above-stated Promotion Period, complete
the official entry form (name, address, daytime
phone number, email address and age) and click
submit. Entry must be received by 7/18/08
at 11:59:59 p.m. Eastern time; or
B. Print your name, address, daytime
phone number, email address and age on a 3” X
5” card and mail it to: Fishing
Trip of a Lifetime Sweepstakes Entries, P.O.
Box 5084, Clinton, IA 52736-5084. Entries
must be postmarked by 7/18/08 and received
by 7/25/08.
C. Written entry forms may be submitted at
participating SouthernLINC retail store locations;
or at SouthernLINC sponsored Movies Under the
Stars events. For participating locations
and dates of Movies Under the Stars locations
visit http://www.southernlinc.com/movies. Entries
at these locations must be received by the
end of close of business at each location on
7/18/08.
Limit one entry per person regardless of method
of entry. No photocopied or mechanically
reproduced entries will be accepted. Sponsor
is not responsible for lost, late, misdirected,
damaged, illegible, incomplete, incorrect misrouted
or postage-due entries/mail, which will be
disqualified. All entries become the
property of the Sponsor and will not be returned. Any
attempt to enter by any other method is void. Sponsor
will fully cooperate with any law enforcement
authorities or court order requesting or directing
Sponsor to disclose the identity of any person
submitting any of the aforementioned information
or materials.
3) PRIZE DETAILS:
One (1) Grand Prize: A 4-day/3-night
trip for winner and one (1) guest to participate
in a two (2) day championship fishing trip
with Tom Mann, Jr. in the Atlantic Ocean
off St. Simons Island, GA on or about 9/23/08 – 9/26/08. Trip
includes roundtrip coach airfare for two
from major airport near winner’s home
to Jacksonville, FL, transportation to and
from the airport, transportation to and from
the fishing trip, three (3) nights double-occupancy
hotel accommodations at The King and Prince
Beach & Golf Resort or comparable resort
and meals while staying at the hotel. Prize
also includes a choice of either a full day
escape spa package or 18
holes of golf for the winner’s guest. The
Full Day Escape spa package at Studio412
includes a 90 minute massage, 90 minute facial,
60 min. pedicure, 60 min. manicure and paraffin
wax, shampoo and blow dry and lunch. All
other meals, taxes, gratuities, and expenses
not specified herein are the responsibility
of the winner. Approximate retail value
$2,500.00; actual value of trip varies based
upon point of departure and airfare fluctuations. Any
difference between stated value and actual
value will not be awarded. In the event
the champion fishing trip is postponed, delayed
or cancelled for any reason outside the control
of the Sponsor, Sponsor shall have no further
obligation, other than to award the remainder
of the prize. The award for the remainder
of the prize will be determined at the sole
discretion of Sponsor. Trip must be
booked 15 or more days prior to the departure
date. Trip must be taken on the dates
specified or prize will be forfeited. Exact
travel dates and arrangements subject to
availability. Additional restrictions
may apply. Prize is not transferable. Sponsor
reserves the right to substitute prize with
similar prize of equal or greater value due
to prize unavailability. No prize substitutions
or cash redemptions except as provided herein. Federal,
state and local taxes on prize are the sole
responsibility of the winner.
4) DRAWING AND AWARDING
OF PRIZES: Potential winner
will be selected in a random drawing from
the aggregate of all qualified entries on
or about 8/1/08. Drawing of winner
will be handled by Promotion Fulfillment
Center, an independent judging organization
whose decisions are final on all matters
pertaining to this sweepstakes. By
their entry, participants are agreeing to
these rules and the decision of the judges,
which are final and binding in all respects. Potential
winner will be notified by email and by mail
and will be required to execute and notarize
an Affidavit of Eligibility and Survey of
Physical Fitness, Release of Liability, applicable
tax information forms and Publicity Release
(where legal) to be returned by potential
winner within seven (7) days of date that
notice is sent or date set by Sponsor, or
prize will be forfeited and will be awarded
to an alternate winner selected in a new
random drawing by Promotion Fulfillment Center,
provided sufficient time remains prior to
trip. Noncompliance with the rules
or aforementioned forms may result in disqualification
of the winner at any time. Potential
winner may be required to provide proof of
legal U.S. or state residency if requested
by Sponsor to determine eligibility and as
a condition to be awarded the prize. Winner
and guest must travel together. Travel
guest of winner must be 21 years of age or
older and will be required to sign and return
a Liability/Publicity Release (where legal). If
winner decides not to bring a guest, no compensation
will be provided in lieu of bringing a guest. If
based on the potential winner's and guest’s
answers to the Survey of Physical Fitness,
Sponsor determines prior to booking travel
that the potential winner or guest is not
physically fit to participate in the fishing
trip, in Sponsor's sole discretion, Sponsor
may elect to award the potential winner a
cash equivalent payment in lieu of the Grand
Prize trip in the amount of $2,500. Tom
Mann and/or O’Neil Williams will make
the ultimate determination as to the winner's
and guest’s physical fitness to participate
in the fishing trip and in the event that
winner or guest is deemed unfit to participate
by Tom Mann and/or O’Neil Williams
after winner travels to St. Simons Island,
GA to meet with Tom Mann and O’Neil
Williams, winner will receive $500 cash in
lieu of the fishing trip and the remainder
of the prize will be awarded as described
above. If prize, prize notification
or attempted notification is returned undeliverable,
prize will be forfeited and will be awarded
to an alternate winner, provided sufficient
time remains prior to trip. WINNER
AGREES TO ACCEPT PRIZE “AS IS” AND
SPONSOR MAKES NO REPRESENTATIONS OR WARRANTIES
OF ANY KIND, EXPRESS OR IMPLIED, AND EXPRESSLY
DISCLAIMS ANY WARRANTY OF TITLE, MERCHANTABILITY
OR FITNESS FOR A PARTICULAR PURPOSE OR ANY
KIND CONCERNING THE APPEARANCE, SAFETY OR
PERFORMANCE OF ANY PRIZE. ODDS
OF WINNING: Odds of winning
are determined by the number of qualified
entries received from all methods combined.
5) GENERAL CONDITIONS: Acceptance
of prize constitutes permission to use winner’s
name and likeness for publicity purposes,
without further compensation in any and all
media now known or hereinafter developed
without territorial restriction (except where
prohibited by law). Participants acknowledge
that there are risks of personal injury,
illness and possible loss of life and risks
of damage to or loss of personal property
that may result from participating in this
sweepstakes and /or prize. Participants
voluntarily enter the sweepstakes and /or
accept the prize and assume all of the risks. Sponsor (including
their employees, directors, officers, affiliates,
subsidiaries, distributors, retailers, agents,
sales representatives, their advertising
and promotion agencies) shall have no liability
with respect to the sweepstakes and/or prize,
and by accepting prize or participating in
the sweepstakes, winner and participants
agree to release and hold Sponsor harmless
for any damage, loss or liability to person
or property, due in whole or part, directly
or indirectly, by reason of the acceptance,
possession, use or misuse of prize or participation
in this sweepstakes or any other prize-related
or sweepstakes-related activities, including
any travel related thereto. Sponsor
reserve the right, in its sole discretion,
to cancel or suspend this sweepstakes or
modify these rules and randomly award the
prize from among all eligible entries received
prior to action taken by Sponsor should fraud,
virus, bugs, technical limitations or failures,
unauthorized interventions or other causes
beyond the control of Sponsor corrupt the
administration, security or proper play of
the game. With respect to computer
entries, Sponsor is not responsible for computer
system, phone line, hardware, software or
program malfunctions, or other errors, failures
or delays in computer transmissions or network
connections that are human or technical in
nature. In the event of a dispute regarding
the identity of the person submitting an
electronic entry, the entry will be deemed
to be submitted by the "authorized account
holder" person in whose name the email
account is registered, provided that person
meets all eligibility criteria set forth
in the Eligibility section of these Official
Rules. "Authorized holder" shall
mean the natural person assigned to an email
address by an Internet access provider, on-line
service provider, or other organization (e.g.,
business, educational institution, etc.)
that is responsible for assigning email addresses
for the domain associated with the submitted
email address. Sponsor reserves the
right, at its sole discretion, to disqualify
any individual (and all of his or her sweepstakes
entries) who tampers with the entry process
or acting in violation of these rules or
acting in a non-sportsmanlike or disruptive
manner or with the intent to annoy, abuse,
threaten or harass any other person. Any
and all disputes, claims and causes of action
arising out of or connected with this sweepstakes
or any travel related thereto, or any prize
awarded, shall be resolved individually,
without resort to any form of class action,
and exclusively by arbitration. Any
and all claims, judgments and awards shall
be limited to actual out-of-pocket costs
incurred, including costs associated with
entering this sweepstakes, but in no event
attorney's fees and/ or any punitive, consequential
or incidental damages. This sweepstakes
is subject to applicable federal, state and
local laws and regulations. All issues
and questions concerning the construction,
validity, interpretation and enforceability
of these rules or rights of the participants
in connection with this sweepstakes will
be governed by and construed in accordance
with the laws of the State of Georgia, U.S.,
without giving affect to its principles of
conflicts of laws.

must be received by 9/01/08.
